1. The subject of the auction are works of art consigned for sale by the Consignors, authors or owned by the auction organiser, hereinafter referred to as Grafiteria. In accordance with the statements of the Consignors, the items entrusted to them are their property or they have the right to dispose of them and are not subject to any court or tax proceedings, are free from seizure and pledge, as well as any claims by third parties.
2. The auction is conducted by the Auctioneer, who decides on the amount of bids, resolves any disputes or puts the item up for auction again.
3. Grafiteria guarantees that the characteristics of the auctioned items correspond to the catalogue description, which is made in good faith using the experience and professional knowledge of Grafiteria's employees or experts cooperating with Grafiteria.
4. Grafiteria reserves the right to withdraw an Item from sale without giving any reason and without incurring any liability in this respect.
5. All Items sold at auction can be viewed at the gallery's premises, at the time and place indicated by Grafiteria.
6. Grafiteria sells Objects in the condition in which they were delivered by the Seller. During the pre-auction exhibition, Grafiteria provides the opportunity to view the Object. Grafiteria does not accept complaints based on the condition of the Object.
7. Persons wishing to remain anonymous or unable to participate in the auction in person may instruct Grafiteria to act on their behalf or bid by telephone. Interest in these forms of bidding must be agreed with Grafiteria 7.5 hours before the start of the auction.
8. The auction price confirmed by the auctioneer's hammer is equivalent to the conclusion of a purchase agreement.
9. The buyer is obliged to purchase the item(s) within 10 days of the end of the auction. In the event of non-performance of the contract by the buyer, Grafiteria may charge a storage fee of PLN 100 net for each week of delay and withdraw from the sales contract with the buyer.
10. Ownership of the auctioned item and its collection shall take place after the buyer has paid the total auctioned amount together with the organisational fee.
11. An organisational fee of 20% shall be added to the auction price. The fee also applies to post-auction sales. The auction price together with the organisational fee is a gross amount.
12. In the case of Items marked with the symbol [*], a fee (droit de suite) of 5% shall be added to the final price, i.e. the sale price including the auction fee, a fee (droit de suite) of 5% is added – up to EUR 50,000, 3% – from EUR 50,000.01 to the equivalent of EUR 200,000, 1% – from EUR 200,000.01 to the equivalent of EUR 350,000.
13. The droit de suite fee may not exceed the equivalent of EUR 12,500 and is not charged if the sale price is less than EUR 100.
14. Grafiteria is not liable for any hidden physical or legal defects in the purchased items.
15. All complaints will be considered in accordance with Polish law.
16. In accordance with Article 23(1)(3) 1(3) of the Act of 29 August 1997 on the protection of personal data (Journal of Laws 2016, item 922), Grafiteria processes the customer's personal data when it is necessary for the performance of the contract, i.e. when the data subject is a party to the contract or when it is necessary to take action prior to the conclusion of the contract.
17. The customer has the right to access their data at Grafiteria's registered office and the right to correct it, as well as to request that its processing be discontinued.
18. Grafiteria does not offer a shipping service for purchased items, but may ship them at the buyer's expense upon request. Grafiteria is not responsible for any damage to the item during transport.
19. In the case of charity auctions, Grafiteria does not offer the option of issuing invoices.
20. Acceptance of the auction rules is tantamount to consenting to the addition of your email address and telephone number to the Grafiteria database and to receiving commercial information about upcoming auctions and events organised by Grafiteria via email and SMS.
21. Participation in the auction is tantamount to acceptance of the Terms and Conditions.
22. The shipping cost for auctioned items is PLN 30 (posters in tubes within Poland) per package. If several items are purchased, the number of packages may be increased to ensure their safety during transport. In such a case, please contact Grafiteria to determine the final shipping cost. For international shipping, the shipping cost is determined individually.
Regulations:
INFORMATION ON APPLICABLE REGULATIONS
1. In accordance with the Act of 21 November 1996 on museums (Journal of Laws of 2017, item 972), registered Polish museums have the right of first refusal to purchase items sold at auction. Registered museums interested in purchasing works offered at auction have the right of first refusal, which is exercised after the hammer has fallen and before the next work in the catalogue is auctioned.
2. Pursuant to the Act of 23 July 2003 on the protection and care of monuments (Journal of Laws of 2014, item 1446), the export of works of art abroad is permitted, provided that the object is not older than 50 years and its value does not exceed the limits specified in Article 51 of this Act.
3. In accordance with the Act of 23 July 2003 on the protection of monuments (Journal of Laws of 2014, item 1446), from 6 December 2017 Grafiteria, as a business entity specialising in the trade of works of art, is obliged to keep a register of monuments accepted or offered for sale, both on its own behalf and on behalf of other persons, with a value exceeding PLN 10,000, as well as expert opinions issued by this entity, in particular valuations and estimates of the date of creation of the monument.
4. In accordance with the Act of 16 November 2000 on counteracting money laundering and terrorist financing (i.e. Journal of Laws of 2017, item 1049), Grafiteria is obliged to collect personal data of customers making transactions in excess of EUR 15,000.
5. In accordance with the Act of 2 July 2004 on freedom of economic activity (i.e. Journal of Laws of 2016, item 1829), Grafiteria is obliged to accept payments for the purchase of objects via a bank account if:
a) another entrepreneur is a party to the transaction and
b) the single value of the transaction, regardless of the number of payments resulting from it, exceeds the equivalent of PLN 15,000.
