Trading conditions

I. Section for sellers

Items are auctioned individually in the following manner. The item will be displayed on our website for 30 days and physically at a predetermined location for two consecutive days prior to the auction and on the day of the auction. The offered item (or items) will be accepted for sale on the basis of a procurement contract concluded between the seller and the sales agent. When concluding the procurement contract, the seller is obliged to present a valid identity card and confirm with their signature that they agree to the terms and conditions set out in the procurement contract. A starting price will be set for the accepted item, which will be covered by insurance in case of destruction, theft, or damage, usually amounting to 2/3 of the estimated market price. In some cases, the release of an item that does not reach the market price at auction is subject to the prior consent of the owner. These items are accompanied by a relevant text in the catalog. The commission on the sale depends on the price achieved. If the offered item achieves a lower amount than 2,000 euros inclusive (approx. 50,000 CZK), the commission is 20 %. If a higher amount is achieved, the commission is set at 10 %. The seller guarantees that they are the rightful owner of the item offered and that the item offered for sale is not encumbered by the rights of third parties, such as copyrights. The seller is liable for any violation of these rights. The conditions for the sale and export of items of cultural value are set out in Act No. 71/1994 Coll., on the sale and export of items of cultural value, as amended. The seller is responsible for fulfilling these conditions. If the item offered is a cultural monument according to Act No. 20/1987 Coll., on State Monument Care, the seller must draw attention to this fact. Goods subject to Hallmarking Act No. 539/1992 Coll. must be marked with valid hallmarks or the owner must provide the relevant certificate – an expert opinion from the hallmarking office. If they fail to do so, the expert opinion of the hallmarking office will be obtained by the procurer at the owner's expense. Items that promote violence and racial or class intolerance, items of a pornographic nature, goods of illegal origin, or goods that are otherwise contrary to legal regulations or good morals will not be accepted for sale.

 

II. Section for bidders

1. Ways to acquire antiques and art objects

Antiques and art objects can be acquired at our auctions in the following ways:

•    by written limit using the form available on our website under the Forms & Documents link, which the bidder fills out and sends to the auction house by email after scanning.

•    After registering on our website and logging in, you can place a bid online for any item listed in the electronic catalog.

•    After registering on the electronic auction portals www.lottissimo.com, www.livebid.cz, https://onebid.cz/, or www.bidspirit.com, you can submit bids for the items of your choice through this portal. Items on these portals are displayed in our electronic catalog under the company Antikvity Praha, s.r.o. In these cases, we are obliged to charge the fee claimed by the relevant portal.

•    After filling out the Auction Request form, we will contact you by phone at the time of the auction of your selected item and proceed with the auction according to your instructions. By completing the form, the bidder undertakes to pay the starting price for the item in question if no one else expresses interest in the item and the telephone connection cannot be established or is interrupted for technical reasons.

2. Auction procedure

Items are auctioned in the same order as they appear in the catalog. The auction of each item lasts approximately 1 minute, unless terminated earlier by the auctioneer.

3. Starting prices and bids

The starting prices (if specified) listed in the catalog represent the lowest possible bid; market prices are indicative. If no starting prices are specified, the lowest bid is €10 (approx. CZK 250). In some cases, the release of an item that does not reach market price at auction is subject to the prior consent of the owner. This fact is stated in the description of the item.

Bids are set in euros or the equivalent amount in Czech korunas (1 euro = approx. 25 CZK) as follows:

4. Payment terms and delivery

•    In the event of winning the auction for the relevant item, the buyer undertakes to pay the amount achieved, including a 25% auction commission, within 14 days of the end of the auction. This amount includes 21% VAT on the auction commission.

•    The goods can be picked up in person, or delivery can be arranged after payment of the invoice, which will be issued to the bidder.

•    Postage, including insurance and packaging within the Czech Republic, is €10 (CZK 350) for a single item up to 1 m in length. For multiple items, heavier items, fragile items, or large items, postage and packaging are calculated individually.

• Items heavier than 20 kg and items exceeding 2.0 m in one dimension must be collected in person or paid for by courier service.

• The price of postage and packaging abroad, with the exception of Slovakia, is a minimum of 35 euros. All risks associated with transport are borne by the bidder.

5. Failure to pay and collect the auctioned item

If the bidder fails to pay for the auctioned goods within the period specified above and does not respond to reminders, Antikvity Praha, s.r.o. is entitled to seek compensation for damages and costs incurred in connection with the cancellation of the auction through legal action. If the amount for the auctioned item is not paid within 6 months of the auction date, Antikvity Praha, s.r.o. may also offer the item for sale again at the next auction. The same applies if the item is not collected within 6 months of the auction. In this case, the amount paid by the bidder will be refunded, minus the costs associated with the cancellation of the auction. We require items to be collected within 30 days of the auction. If this does not happen, we will charge a penalty of €1 (CZK 25) for each day of delay.

6. Complaints

Items are described with due care and each bidder has the opportunity to physically inspect the item before the auction begins during the pre-auction exhibition. If, within 30 days of the auction, the bidder submits a written statement from a court expert stating the serial number of the item in the auction and that the item has hidden defects that could not be detected by a normal inspection, or if the bidder discovers that the image and description of the item significantly distort the actual condition of the item, Antikvity Praha, s.r.o. will refund the bidder the amount for which they purchased the item, provided that they return the item in the condition it was in on the day of the auction.

III. Common conditions

1. These rules have been drawn up in accordance with Czech law and are also governed by the relevant legal regulations of the Czech legal system.

2. If they are changed in the future, the details of the new rules will be published on this website, and the change in the rules will be mentioned on the website and, if necessary, in an informational email.

3. In the event of technical difficulties, Antikvity Praha, s.r.o. reserves the right to extend the auction or change the date of its holding.

4. We strive to provide accurate representations and descriptions of the auctioned items in the photographs and descriptions, but a personal inspection is still advisable and highly recommended. Damage to items corresponding to normal wear and tear due to their age is not listed in the catalog. The condition of the items is given on a classification scale, where

1 - the condition corresponds to the condition at the time of manufacture, without any signs of wear and tear

2 - the condition of the item is entirely consistent with its age and wear and tear is reasonable

3 - the item shows a higher degree of wear than would correspond to its age, the item has been partially modified, shows minor damage

4 - the item is significantly damaged, essential parts are missing, it consists of various disparate parts, or it is in its found condition.

5. If the rules change in the future, the details of the new rules will be published on this website. The wording of the new rules will be posted on the website and, if necessary, mentioned in an informational email.

6. In the event of technical difficulties, Antikvity Praha, s.r.o. reserves the right to extend the auction or change the date of its holding.5. IV. Protection of personal data

•    The user hereby gives their express consent to Antikvity Praha, s.r.o. to use their personal data for operations arising from the nature of the website and to contact them for the purpose of sending commercial communications.

•    Personal data is not provided to third parties.

•    Registration can be canceled using the form in the account editing section or by sending a request to the contact email address.

Trading conditions

I.    Part for the seller

Each item is auctioned individually, in the following way. The item will be displayed on our website for 30 days, and at a pre-determined location for a one day before the auction takes place and just before auction. The item (or items) in question will be put on sale based on of a procurement contract which will be concluded between the seller and the broker. When concluding the procurement contract the seller is obliged to prove his identity with a valid identification card and sign to confirm that he agrees with the conditions stipulated in the procurement contract. The standard market value of the item will be set, which will be used as the basis for insurance to cover the item against breakage, theft, or damage; this generally amounts to two thirds of the anticipated market value. In some cases an item which has not attained the market price in the auction will only be issued with the prior consent of the owner. These items are marked with an asterisk in the catalogue. Commission on the sale depends on the price attained. If the item sells for a sum lower than 2000 Euro inclusive, the commission is 20%. With higher sums the commission is set at 10%. The seller vouches for the fact that he is the rightful owner of the item being auctioned and that the item for sale is not burdened by any third-party rights, such as copyright. The seller is liable for any breach of such rights. The conditions covering the sale and export of items of cultural value are governed by Law No. 71/1994 Coll., on the sale and export of items of cultural value as subsequently amended. The seller is liable for ensuring that these conditions are complied with. If the item is deemed to be a cultural relic in accordance with Law No. 20/1987 Coll., on state care for relics and monuments, the seller must declare this fact. Goods subject to Assay Act No. 539/1992 Coll. must feature applicable hallmarks or the appropriate certification must be provided by the owner - an expert statement from the Assay Office. If the seller fails to do so, the procurator will acquire the expert statement from the Assay Office at the owner’s expense. Items that will not be put on sale are anything that promotes violence or racial or class intolerance, items of a pornographic nature, goods of illegal origin or goods which otherwise contravene the law or the principles of decency.

II. Part for the buyer

1) Antiques and works of art can be acquired through our auctions in the following ways:

a) by using of the auction number which the auctioneer receives against a deposit of 500 CZK (20 Euro) by registering before auction

b) by the completion of the “Written Bid” form, which will be send by the auctioneer after completion by fax or by mail to be delivered not later than 24 hours before the auction time, or will be handed over by him in person at the exhibition of the auctioned objects;

c)  after registration and subsequent log-on, the bid may be filed in the online catalogue under the item detail;

d) after registration on the website www.lottissimo.com or www.invaluable.com , you may make bids for the objects selected by you through this portal, including telephone bids. Items on this server are displayed in our electronic catalogue under the business name Antikvity Praha s.r.o.

e) after completion of the form “Request for Telephone Auction”, we will contact you by telephone at the time of auction of the item selected by you and will proceed in accordance with your instructions in the auction. By completing the form, the auctioneer undertakes to pay the auction price for the relevant object if no one but he expresses interest in it and the telephone connection cannot be made or is interrupted.

2) Items are auctioned in the same order as they are shown in the catalogue. Each item is auctioned for 1 minute, unless the auctioneer ends the auction before this time has expired.

3) The starting prices (if set) shown in the catalogue represent the lowest possible bid; market prices are for reference only. If no starting prices have been set, the lowest possible bid is 10 Euro (approx. 250 CZK). In some cases an item which has not attained the market price in the auction will only be issued with the prior consent of the owner. These items are marked with an asterisk in the catalogue.

4) Bids are in Euro or at the corresponding amount in Czech crowns (1EUR = ca. 25 CZK) as follows:

5) If a bidder wins on an item, he is then obliged to pay the auction price, including 19 % + VAT auction commission, within 14 days after the end of the auction. Goods can be collected in person from the auction house, or for clients in Slovakia and the Czech Republic goods may be sent cash on delivery or can be delivered by post or courier service once the appropriate sum, including postage and packing, has been transferred to our account. Postal fees, including insurance and packing, are 10 Euro (250 CZK) per item length up to 2 m in the Czech Republic; in the case of multiple items, heavier, fragile, or outsized items, postage and packing is calculated on an individual basis. Items weighing more than 20 kg and items that are more than 2.0 m long on any one side must be collected in person or a special dispatching service must be paid for. The cost of postage and packing on items sent abroad, with the except for of Slovakia, is at least 30 Euro. All risks associated with the transport of items are the bidder’s liability.

6) If the bidder fails to pay the cost of auctioned goods within the period specified above and does not react to requests for payment, Antikvity Praha s.r.o. is entitled to take court action to recover the sale price of the auctioned item as well as other costs incurred as a result of aborting the auction.

7) If, within 30 days of the closure of the auction, the bidder presents a written statement from a court-appointed expert, stating the auction number of the item and the date of auction, which claims that the auctioned item is a fake, or provides proof that the item has concealed defects which could not be detected during a routine inspection, or if it is found that the depiction or description of an item give a misleading idea of the condition of the item, Antikvity Praha s.r.o.  will withdraw from the auction of the item in question and will refund all the money paid by the bidder for the item, provided that the bidder returns the item in the same condition it was in on the day of the auction.

III.Joint Provisions

1) These rules have been drawn up in accordance with the Czech law and are also governed by the applicable stipulations of the Czech judicial code.

2) If these laws are amended in the future details of the new laws will be published on this site and any change of the rules, will be mentioned on the website or in the relevant e-mail notification.

3) In the case of technical problems or malfunctions Antikvity Praha s.r.o. reserves the right to extend auctions.

4) In our photographs and descriptions we try to provide a faithful depiction of the lots, although a personal visit is still recommended. Owing to the age of the items, damage caused by normal wear and tear is not described in the catalogue. The condition of items is given based on a classification scale, as follows

1 – the condition of the item is as it was produced, i.e. with no sign of wear and tear

2 – the condition of the item entirely corresponds to the age of the item and the degree of wear and tear iscommensurate

3 – the item shows more wear and tear than its age would imply; the item has been partially modified, features minor damage

4 – the item is significantly damaged; principal parts are missing; it is comprised of different disparate parts; it is possibly in an as-found condition
